Interning at agencies, organizations, or businesses in Vietnam is considered a special case for foreign students. To comply with Vietnamese law, instead of applying for a work permit like a regular employee, the company must follow the procedure to obtain a work permit exemption confirmation for the intern. This process ensures that both the business and the intern operate legally and that the rights of both parties are protected.
I. Process Overview
The process for a foreign student to intern in Vietnam consists of two main steps:
Request for Approval to Use Labor: This is an internal step for the business. The company must submit an application to the local Department of Labor, Invalids, and Social Affairs to explain and seek approval for its need to host a foreign intern.
Application for Work Permit Exemption: After receiving the approval from the authorities, the company will proceed with submitting the application for the work permit exemption confirmation for the intern. The application must strictly adhere to the document requirements and match the job position approved in Step 1.
II. Required Documents
The application for a work permit exemption for a foreign intern must include the following documents:
Form 09/PLI: This is the official form used to request a confirmation that the foreign worker is not subject to a work permit. The company must fill out this form completely and accurately.
Documents Proving Intern Status:
Student Confirmation Letter: A confirmation letter from the university, college, or foreign training facility where the student is currently enrolled. This letter must include detailed information about the student and their academic status.
Internship Assignment Decision: A decision letter from the foreign educational institution, stating that the student is assigned to an agency, organization, or business in Vietnam for an internship. This also applies to apprentices on Vietnamese vessels.
Health Certificate: A valid health certificate issued within the past 12 months from the date of application. The health check must be performed at one of the hospitals in Vietnam authorized by the Ministry of Health to conduct examinations for foreigners.
Passport: A notarized copy of the passport or a copy certified by the employer, which must be valid according to the law.
Important Note on Foreign Documents: All documents issued in a foreign country must undergo consular legalization unless an exemption applies. This process involves two steps:
Authentication from the Issuing Country's Authority: The document must have a confirmation or stamp from the diplomatic or foreign affairs agency of the country that issued the document.
Authentication from the Vietnamese Embassy/Consulate: Following this, the document must be consularly legalized at the Vietnamese Embassy or Consulate in that country.
