Exemptions from work permits that do not necessitate a certificate of exemption
In Vietnam, there are specific cases where foreign workers are exempt from the work permit issuance procedure. Unlike other exemption cases, these do not require a confirmation of exemption. Instead, the company employing the foreign worker only needs to report to the labor management authority (Department of Labor/Ministry of Labor) in the locality where the foreign worker intends to work.
This report must include the following information: full name, age, nationality, passport number, name of the foreign employer, and the start and end dates of work. This report must be submitted at least 3 working days prior to the expected start date of work in Vietnam.

Cases Exempt from Work Permits Without a Certificate
In the following situations, foreign workers are not required to undergo the procedure for confirmation of non-applicability for a work permit:
Short-Term Service Providers: Foreigners entering Vietnam for less than 3 months to provide services.
Licensed Foreign Lawyers: Foreign lawyers holding a license to practice law in Vietnam.
Direct Investors (Owners/Members): Foreign owners or limited liability company members with a direct capital contribution of VND 3 billion or more.
Direct Investors (Chairmen/Board Members): Foreign chairmen or members of the board of directors of a joint stock company with a direct capital contribution of VND 3 billion or more.
Short-Term Managers/Experts/Technicians: Foreigners working in Vietnam as managers, directors, experts, or technical workers for less than 30 days and no more than 3 times in one year.
Family Members of Diplomatic Representatives: Family members of foreign diplomatic representatives in Vietnam.
Therefore, if your foreign employees fall into any of the aforementioned categories, your company will not need to go through the procedures of obtaining a labor permit exemption certificate or follow processes such as job posting and reporting as required for cases with work permits. Your company only needs to report to the state management agency before the foreign employee starts working, in accordance with the regulations.
