Required Documents for Foreign Technical Workers

The required documents for issuing new work permits for technical workers in Vietnam include:

  • At least 1 year of training and 3 years of relevant experience in the intended position in Vietnam;

  • Or at least 5 years of relevant experience in the intended position in Vietnam.

Depending on the specific case, technical workers may need to provide either a diploma or certificate, or both the certificate and a verification letter from a foreign organization, institution, or enterprise regarding their years of experience.

In addition, other personal documents of the foreign technical worker must be prepared, including:

  • A health certificate or medical examination certificate issued by a competent health agency of a foreign country or Vietnam, valid for 12 months from the date of the health conclusion to the date of submission of the application, or a certificate of sufficient health as prescribed by the Minister of Health.

  • A criminal record certificate or a document certifying that the foreign worker is not currently serving a sentence or has not had a criminal record expunged or is currently being prosecuted for a crime by a foreign country or Vietnam. The criminal record certificate or document certifying this status must be issued no more than 06 months prior to the date of submission of the application.

  • Personal documents such as: passport, visa, 4x6 cm portrait photo with a white background.

Procedures for Issuing New Work Permits for Technical Workers

To apply for new work permits for technical workers in Vietnam, the following steps must be followed:

  1. Job Posting: According to the law, job postings must be made in the province or city where the foreign worker will be employed. Based on the establishment permit, the job posting is usually conducted through the provincial/city employment center for a period of 15 days.

  2. Request for Approval to Use Foreign Labor: This step, also known as explaining the need to use foreign labor, involves requesting approval for the specific position. The processing time for this step is 15-20 days.

  3. Work Permit Application: Submit a work permit application based on the approved position and documentation.
