Reissuance of work permit for foreign workers in Vietnam

During their time working in Vietnam, foreign nationals may encounter situations where their work permit is lost, damaged, or requires information changes (due to oversight or unforeseen circumstances). In such instances, it's essential to follow the procedure for reissuing a work permit for foreigners. We advise initiating this reissuance process as soon as possible after any loss or change occurs, as the procedure is generally straightforward and convenient.
 

Specific Cases Requiring Work Permit Reissuance

Here are the specific scenarios that necessitate the reissuance of a work permit:

  • Lost Work Permit: If your valid work permit is lost, you must immediately report it to the local police (ward/commune police), the company's headquarters (if the loss is suspected there), or the place where the incident occurred. Remember to request a confirmation of your report from the police.

  • Damaged Work Permit: If your valid work permit is damaged, you must retain the original damaged permit and prepare a written statement, confirmed by a company representative, detailing the damage.

  • Information Changes: If any of the following information on your valid work permit changes: full name, nationality, passport number, place of work, or company name (without changing the business registration code).

    • For changes in foreign worker's name, nationality, or passport number: Please prepare a new passport to complete the reissuance procedure.

    • For changes in the workplace: If the company relocates within the same province/city, please provide the amended business registration. If the company relocates to a different province/city, you will typically need to reapply for a work permit at the new location.

    • For changes in the company name without changing the tax code: You must reapply for a labor use approval before proceeding with the work permit reissuance procedure.

A new work permit should be issued promptly following any changes or loss
 

Required Documents for Work Permit Reissuance

To apply for the reissuance of a work permit, the following documents are typically required:

  • A written request for reissuance of the work permit from the employer, as per Form No. 11/PLI, Appendix I.

  • Two color photographs (4 cm x 6 cm in size, white background, frontal view, bare-headed, no tinted glasses), taken within the past 6 months.

  • The valid work permit previously issued:

    • If the work permit is lost, a confirmation from the local police authority where the foreign worker resides or a competent authority of the foreign country, as prescribed by law, is required.

    • If there are changes in the information on the work permit, supporting documents are required.

Within 03 working days from the date of receipt of a complete application for reissuance of a work permit, the Ministry of Labor, Invalids and Social Affairs or the Department of Labor, Invalids and Social Affairs shall re-issue the work permit. In case of refusal to re-issue the work permit, a written reply stating the reasons will be provided.
